Terms and Conditions of Purchase from Bark Control Australia

Acceptance

Your use of the BCA website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below (known as Terms and Conditions) and placing an order constitutes your agreement to the Terms and Conditions. BCA reserves the right to amend the Terms and Conditions from time to time and they can be viewed here. Your continued use of the website constitutes acceptance of amended Terms and Conditions, as amended. You should read them now.

Images displayed offer a fair representation of the corresponding products. They may not be absolutely accurate in colour or content due to model changes, etcetera. Prices apply to the number of items listed in the text, not in the images. Please contact us if you need to confirm any details.

Legal Capacity

Goods on the website are only available for sale to individuals who can make legally binding contracts. They are not available to:

·         persons under the age of 18 years

·         persons who lack the capacity to enter into binding contracts

·         other persons who are legally prohibited from entering into binding contracts. 

Orders

Your order is considered a promise to buy. Orders must be placed in good faith and all information given must be true and correct.

BCA reserves the right to accept or reject your offer for any reason, including, without limitation, the termination of sale prices or other special deals, unavailability of any product, an error in the price or the product description posted on this website, or an error in your order.

Notice of receipt of your order does not in itself constitute a contract. Your contract with BCA only arises when BCA receives payment and forwards the goods you have ordered.

You may cancel an order prior to the goods leaving the BCA premises. BCA regrets that once the goods have been dispatched an order may not be cancelled and will be treated as a return (see return policy). 

Prices

BCA reserves the right to amend, from time to time, prices of products and delivery and other charges displayed on this website.

 Delivery

Please see the information contained in the Delivery section of the website.

Delivery times shown are indicative only and partly dependent on the carrier’s performance. BCA endeavours to deliver goods as quickly as possible but will not be liable for any failure to achieve the indicative delivery times.

Title

BCA retains title to the goods you order and title only passes after full payment for those goods is received. BCA can retain or resell any goods, until title passes.

Risk

 

All returned goods are at your risk in transit and damage/losses often are not covered unless you make special arrangements with your carrier. BCA recommends that you consider registering and insuring your goods before consignment, for return to us. Unfortunately, we cannot accept any responsibility for goods that are lost or damaged in transit.

Please note that e collars should not be returned from overseas unless prior arrangement has been made. Failure to do so may result in the collar being seized by Customs and BCA will not be liable for any loss incurred.

 

Warranty

Our products are sold with manufacturer's warranties of up to 10 years. BCA does not offer any warranty in addition to or above any given by the manufacturer.

Disclaimer

While information displayed on the website or given by other means such as telephone, fax or e-mail is believed to be accurate and current, it is provided by BCA on a “good faith” basis only. Neither BCA, its owner, or any employees or agents make any representation or warranty as to the reliability, accuracy or completeness of the information provided.

Linked sites are believed to be of a high standard but they are not maintained or controlled by BCA and BCA will not accept any responsibility for the accuracy, ownership or any other aspect of the information contained on those Web Sites. You should make your own decisions about dealing with linked sites.

Viruses

It is your responsibility to check any e-mails or files obtained from or through this website or its linked websites for the presence of viruses or other problems. BCA, its owner, employees and agents accept no liability for any loss or damage caused by any virus or other problem obtained from or through this website or linked sites.

Limitation of liability

BCA will not be liable in any way for any direct, indirect, incidental, special or consequential losses or damages resulting from use of the website or inability to use the website, even if BCA has been advised of the possibility of such losses or damages, including, but not limited to:

·         loss of profits, loss of data or other intangibles

·         costs of purchasing substitute products

·         costs or damages resulting from or related to any products purchased or obtained

·         messages received or transactions entered into through the website

·         resulting from unauthorised access to, or alteration of your transmissions or data

·         resulting from or related to any information contained on this website.

·   Any imposed liability shall be limited to re-supply of information or goods.

Disputes

By using this site you agree to be bound by Queensland consumer law and that any dispute that may arise will be settled within the Queensland jurisdiction.  

 

 

Return Policy

 

Risk

Money Back Guarantee/Trial Details

 

Some products are offered with a 10 day trial period or a 10 or 30 day money back guarantee to perform (e.g. stop nuisance barking in the case of bark control collars) when used in accordance with manufacturer’s instructions.

These trial periods and guarantees are offered on a joint responsibility basis, whereby purchasers agree to follow manufacturers’ instructions, training and any recommendations given by BCA, within the prescribed period.

If, after following instructions and carrying out any prescribed training, the product does not work for your pet, BCA will exchange it for an alternate type with either a credit or debit adjustment being made to account for any price difference or refund the receipted purchase price (less cost of consumables) provided that:

  • you advise BCA of the reason/s prior to returning the product  
  • products are returned in original condition (preferably with their original packaging)
  • products are accompanied by your original receipt
  • products are not damaged in transit
  • you pay costs of return and any consumables (e.g. batteries, wire, refills, soiled straps)

Deductions will be made from the receipted price to cover actual delivery cost, any damage, excessive wear and tear, missing parts/accessories/packaging and record searching, if needed.

Return shipping cost is not covered.

PLEASE NOTE: The equipment must be maintained and kept in good working order during the trial or guarantee period so it can perform as intended by the manufacturer. Failure due to lack of maintanance, accidental damage and/or damage by dog/s is not covered but warranty may apply in cases other than damage by dogs or accident.

Exchange

If, within 7 days of receipt, you are not happy with your purchase, BCA will exchange any item for another/others of equal value provided that goods are:

  • returned unused, in new condition, in their original, unopened packaging  
  • accompanied by your original receipt
  • received in new condition and not damaged in transit
  • you pay for both return and actual delivery costs

Deductions will be made from the receipted price to cover actaul delivery costs, missing parts/accessories/packaging and record searching, if needed.

 

Defects

 

Any item purchased from BCA that is found to have manufacturing defects covered by the manufacturer’s warranty will be exchanged wherever possible to minimise delay and inconvenience.

However, some items have to be assessed for possible repair prior to replacement.

In respect to any goods sent to us for repair/replacement please:

  • note that a test and return shipping fee (minimum $15) is payable prior to return to you of any goods that are found not to be faulty** 
  • include your original receipt (warranty claims may not be processed without proof of purchase)
  • include your contact details and a note outlining your concern/s
  • note that shipping to us or to a distributor is at your cost but goods will be returned at no cost to you unless a fault cannot be found

**The products we sell are reliable and most apparent problems can be solved by reading product instructions or contacting us for help via email or phone.

Address for Returns

Please do not return non refundable consumables such as used batteries, soiled collar straps, citronella cans, unspooled wire or ANY CITRONELLA SPRAY PRODUCTS. It is not legal to send pressure vessels (including Citronella cans) by post and doing so may lead to prosecution and/or fines.
